Declaration of Rights of Farmers and the Community of Fauquier County

Here is the text of the Declaration of Rights of Farmers and the Community of Fauquier County.

WHEREAS, active farms and farming in Fauquier County play an important role in the vitality of the County, the private lives of County residents, and the very constitution of the County as a community; and

WHEREAS, active farms and farming have historically played an important role in Fauquier County, and are protected under the supreme, fundamental and paramount American law guaranteeing certain unalienable rights such as life, liberty and pursuit of happiness; and

WHEREAS, the success of active farms and farming depends on remuneration resulting from farmers’ labor, ingenuity and products; and

WHEREAS, each farmer and each owner of farmland has the right to determine in his or her own estimation what best constitutes farming and the best uses of the land and property that he or she owns, the products that he or she may offer to best sustain the farmer and his or her family, and that each farmer has the right to remuneration for his or her labor, ingenuity and products; and

WHEREAS, each farmer and each owner of farmland has the right to the quiet enjoyment of his or her land, the right of peaceable assembly on his or her private property, the right to exercise religious freedom on his or her private property, and other rights reserved to all people by America’s supreme, fundamental and paramount law; and

WHEREAS, whenever farmers desire to open their farms to commerce with the people of the community, those people have the right to purchase directly from farmers the products offered by farmers under terms established by the farmers; and

WHEREAS, when the people of the community enter the land and private property of farmers as guests at the invitation of, or otherwise under the terms set by, farmers, they have the right to enjoy the unique characteristics and blessings of farm life offered them by farmers and free from the dictates of Fauquier County; and

WHEREAS, Fauquier County may not restrict the rights of farmers or their guests from the community, or categorize farmers, farming or farmland in any way that diminishes their freedoms, based simply on the fact that they are farmers or the guests of farmers, or own farmland; and

WHEREAS, with few exceptions, farmers respect their neighbors and community; they seek not to trespass on their neighbors’ rights or harm members of the community; they indeed rely on the goodwill of their neighbors and the community; and that only the actual trespasses and harms caused by farmers on their neighbors or the community may be prohibited through regulation; and

WHEREAS, through zoning ordinances and the dictates of permits, Fauquier County has trespassed on the rights of farmers to engage in agricultural activity, which by its very nature includes the right to remuneration for each farmer’s labor, ingenuity and products, and

WHEREAS, through zoning ordinances and the dictates of permits, Fauquier County has trespassed on the rights of farmers and their guests to engage freely in wholesome activities that do not endanger the health, safety or welfare of the community, including but not limited to pumpkin patches and corn mazes; and

WHEREAS, Fauquier County lacks the legal and moral authority to regulate farms and farmers in ways that violate and trespass on the rights of quiet enjoyment, and that the July 14, 2011 ordinance amendment to Sections 3-318.21 and 5-1812 requiring a farm sales special permit (the “Restrictive Farm Sales Permit Ordinance”) is therefore an unlawful and disdainful ordinance.

BE IT THEREFORE DECLARED, that we the undersigned respectfully but fervently:

Demand that the Fauquier County Board of Supervisors repeal the Restrictive Farm Sales Permit Ordinance;

Demand that no official or employee of Fauquier County enforce the Restrictive Farm Sales Permit Ordinance pending its repeal; and

Demand that Fauquier County not replace the Restrictive Farm Sales Permit Ordinance with any ordinance that restricts the rights of farmers or their guests as identified herein.

Therefore, we the undersigned declare that attempts to enforce the Restrictive Farm Sales Permit Ordinance will be deemed a trespass and a violation of rights, and that residents of Fauquier County are free to use all lawful means to protect their rights.

I am proud to support the farm bill of rights.
James Madison, the author of the first "Bill of Rights", won his first congressional election even after Patrick Henry gerrymandered Fauquier County out of his election district because Fauquier was a Federalist County.Now is the time for Fauquier County to support a return to citizen rights as our founding fathers saw them.

Fauquier county has become a joke with its beurocrat bullying and it's only a matter of time and money before they get stopped in their tracks and it gets back to where it was 13 years ago

At some point, when enough laws are made, we all become lawbreakers. Today it is farmers, tomorrow it will be all property owners.
At what point will we not be truly free anymore? I believe it occurs at the moment we stop standing up for our basic freedoms.
Signing this petition is taking that stand.
