Who Is Really In Charge?

Do you grumble and snarl at what is happening right here in your own County?

What do you like and what do you dislike about the direction your own county is moving?

Then ask yourself what is wrong here and what can I do to change it!  It is up to you to change things if you really believe in the primary values of our nation.  Why did our ancestors leave England and how did they survive such hardships?  Have you been true to the foundation?

The answer is a resounding NO!  Freedom was the virtue that these noble men and women possessed; freedom of life, liberty, and the pursuit of happiness.  What is “the pursuit of happiness”?  It is earning the things that you hold dear.  Once you earn it, you have the right to fully possess it and use it to make your life comfortable and fuller.

Our Declaration of Independence states “We hold these Truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness.  That to secure these Rights, Governments are instituted among Men, deriving their just powers from the Consent of the Governed.”

This clearly means that government has the one purpose of securing our Rights.  Unfortunately, we have allowed government to take these Rights instead of protecting them.

What will you do about that?  Let’s begin here in Fauquier County.

We have a Board of Supervisors that is elected to secure our rights while passing ordinances that are intended to protect the health, safety and welfare of the public.

Each county must ask the Virginia Assembly for permission to act in certain areas.  The Virginia Assembly has the Constitution of the Commonwealth of Virginia and the Commonwealth of Virginia must abide by the United States Constitution.  The failure to follow the Constitution is an unlawful act.

Fauquier County Board of Supervisors is currently made up of five men who represent each of the five magisterial districts.  These elected men have assumed the role of leadership.  These men are good men, but subject to human thinking.

Each Ordinance is the product of some human thoughts and wishes.  A good man in leadership will honestly judge if the Ordinance is intended to secure the Life, Liberty, and the Pursuit of Happiness while protecting the health, safety and welfare of the people of this county.

Even if pressure by close friends and large groups of voters cause personal pain and heartburn, he must to the lawful thing.  The Constitution is the Law of the Land and it governs government.  To act otherwise is lawbreaking.

Government officials everywhere must acknowledge that this paramount, supreme law must be obeyed or the literal foundation of government crumbles and is gone.  The heart of the nation is broken and death of the nation will follow.

It takes time for total corruption to be exposed, but it will come before death.  This corruption runs deep in America today.  If we as citizens do not take our role of leadership and point out the truth to elected government, they can deny wrongdoing and we suffer.  Our Board of Supervisors has acted unlawfully.  If any member does not recognize where they acted unlawfully, look at the Zoning Ordinances for openers.

These Zoning Ordinances cover the majority of our “Pursuit of Happiness”.  We have accumulated land and a home and a business to afford the cost of having same.  Every Zoning Ordinance puts a restriction on the rights to this land and business.

The restrictions do not really affect the health, safety and welfare of the people.  Remember that at the time the Constitution was written the Dictionary definition of welfare said “that which is well and fair”.  It had nothing to do with the desires of anyone, only what was good for all.   Can you honestly say that about Fauquier Zoning Ordinances?

The Laws of any jurisdiction are to be enforced by the Law Enforcement Agency of that jurisdiction.  In this case, it would be the Fauquier County Sheriff’s Department.

Yet a complaint goes to a Department of the County Government which has no connection with law enforcement.  The complaint is upheld and enforced by the Zoning Department Administrator without any investigation as to truth, details or validity.  An excessive fine (much greater than a Court of Law covering Virginia Code violations) can be levied by this Department Head.  An appeal can only be heard by another unelected Board of County Government by paying a $500.00 fee just to be heard.  The record of winning an appeal is 99% against you.

These Ordinances are passed by the Board of Supervisors and they give the Zoning Administrator the authority to enforce them.  So, again, our County Board of Supervisors has a long record of being the greatest lawbreaker.

This was accomplished by a lot of good people failing to be honest and incorruptible.  They meant well, but blamed someone else for things that went ahead of them and failed to say this is wrong and illegal.  They continued to be illegal.

Not only is this unlawful, but is has been used to single out certain persons.  They have been bullied, fined, closed for business, unfairly accused, and shut out of the business world.

For instance, follow “Martha the Farmer” story and the wineries that have had to close because of curtailment of business hours. Who pushed for these closings even when the County Attorney warned that the Ordinances were against the Virginia Right to Farm Bill?

Those who are greedy enough to take your property rights count on the fact that it will cost more than you can afford to defend your rights.  They use your tax money to enforce their unlawful Ordinances and pay the legal fees to take you to court if you file against the Ordinance.

To change all this, we could be saved millions of dollars.  Now is the time to bring Fauquier County out of the red and back into the legal world.  When we act according to the Constitution of the Commonwealth of Virginia and the Constitution of the United States of America, we can shed costs that will eliminate the need for tax hikes and have a surplus to do good things.

We must first recognize that this nation is a Republic — ruled by Law.  We are not a Democracy — mob rule.  Our Constitution is based on Biblical Law — well, fair and clearly laid out.

Since we still are a Republic, speak to your Supervisor.  Speak up for your property rights.  You have the right to the full benefit of your property unless it endangers another’s health and safety in all fairness.

If an Ordinance takes away your property rights, speak to your Supervisor and work out a plan where the Ordinance fits into the Law of the Land or drop it.  Stand firm in the fact that this will no longer be a lawbreaking County.
